Summary/Abstract: The intention of the employer to make redundancies is firstly discussed with the union or the employees’ representatives and then communicated to the territorial labour inspectorate and the territorial employment agency. The employer tries at first to achieve a consensus by informing and consulting with the employees, but if this fails, he is free to effect collective redundancy, according to his interests.Information, data provision, consultations and negotiations are carried out in order to find solutions to avoid collective redundancies or to reduce the number of employees made redundant, and represent legal guarantees of the right to work, a right which, under the article 38 (1) of the Romanian Constitution, cannot be restricted.
