Summary/Abstract: Given that the information and consultation is an application of social dialogue in matters of collective dismissal, it must be examined what it means, how it works and what has been the trend of laws and jurisprudence in this matter, ie social dialogue, in order to see if this application only protects employees, or is simply a deliberate obstacle to a faster approach of an employer’s wish to organize its activity. We will analyze this relationship effect and the role of trade unions or employee representatives in the Member States of the European Union and in non-EU countries, respectively in US- trade unions.This study will reflect the importance of a connection - communication - between social dialogue in one unit for the proper functioning of the company, not only on the business side but also to safeguard the employees' right to work.
