THE VALIDITY OF THE ENVIRONMENT PERMIT/INTEGRATED ENVIRONMENTAL PERMIT. BRIEF CONSIDERATIONS BASED ON THE LEGISLATIVE MODIFICATIONS IN THIS AREA

Summary/Abstract: Beyond the difficulties faced by our country in the implementation of the European Union’s legislation in the area of environmental protection, legislative instability, the lack of predictability and accessibility of the norms in an area of special practical importance, as it is the case of the authorization for activities with a significant impact upon the environment, generates a feeling of uncertainty for the person aiming to begin or to continue an activity with impact upon the environment, as well as distrust in the continuity of the state activity. Starting from the current legislative context and from the fact that, objectively, the subject of law is exposed to arbitrariness if he cannot know or often understand the rules of law to which he must obey, this article aims to clarify the issues related to the legislative changes in the last period regarding the validity of the environmental permits/integrated environmental permits.
