Ius civile, ius gentium and the Law of Emperors

Summary/Abstract: The text is dealing with reflection of Roman law and its components (ius civile, ius gentium and the law of emperors) concerning dissolution of testament. Ius civile allowed only drawing up a new testament, which dissolved the previous one. Ius praetorium (under influence of ius gentium) enabled dissolution of testament by mere revocation or destroying. This chronological order is respected by arrangement of the new Czech Civil Code (Act No. 89/2012). Apart from drawing up and revocation of testament is the text dealing also with problems of synchronous validity of more testaments, which was possible in Roman law only in case of military testament. This Roman law exception became a rule in modern law. It is another example of modern civil codes inspiration by Roman military testament.
