Entry in the Roll of Legal Advisers: Selected Issues in the Context of Applying Administrative Procedure Code

Summary/Abstract: The article analyzes selected procedural issues connected with entries in the Roll of Legal Advisers. In particular, it takes on the topic of the due course of instance in administrative proceedings concerning entry in the Roll of Legal Advisers by examining the question of whether the Minister of Justice should be considered a possible third instance in such proceedings or an oversight authority. With the assumption that the Minister of Justice is an oversight authority in relation to the proceedings, possible scenarios for concluding the proceedings have also been analyzed. Further on in the article, the catalogue of parties to the proceedings concerning entry in the Roll of Legal Advisers has been discussed, while analyzing, among other things, the relationship between Article 28 of the Administrative Procedure Code and Article 31 of the Act on Legal Advisers.
