Summary/Abstract: The gloss addresses the resolution of the Supreme Court of 8 October 2015 (III CZP 53/15) on the possibility of changing interest rates on fees for perpetual usufruct of land connected with a parking space in the event the right of perpetual usufruct was acquired prior to entry into force of Article 73(2a)(1) of the Act on the Management of Real Property. In the resolution the Supreme Court confirmed the lawfulness of changing the percentage rate of the fee for perpetual usufruct from 1% to 3%. The gloss contains a critical analysis of the position taken by the Supreme Court. The first conclusion drawn by the author is that the Supreme Court violated Article 2 of the Constitution and the principle of respect for acquired rights expressed therein. Secondly, the reference to Article L of the Implementing Provisions to the Civil Code made by the Supreme Court does not appear convincing. Conversely, the author believes the Supreme Court should have applied Article XL of the Implementing Provisions to the Civil Code, whose application would have resulted in a different decision by the Supreme Court.
