Summary/Abstract: In relation to their position on the conditions that led to the criminalization of a deed, the contemporary criminal doctrine divides the theoretical approaches into two cate¬gories: formal conceptions, for which an offense exists only within the limits of an incri¬minated act and the material conceptions for which the substantial processes that led the legislator to criminalize an act and attribute to it a socially dangerous character are important.The author tries to determine which of these two concepts better represents the interests of society.
