Summary/Abstract: In view of the fight against pedophilia that exists throughout the Western world, the Brazilian legislator banned the marriage of a minor under the age of 16, incorporating the doctrinal discussions about the marriage of a minor under the age of 16, which, once perfected, would generate the effects of the absolute or of the relative nullity, the discussion of which is relevant by the occurrence or not of the extinctive prescription regarding the possibility of validating a legally prohibited marriage.
