The economic compensation in Argentine law. Jurisprudential criteria

Summary/Abstract: The purpose of economic compensation is to reestablish the imbalance that exists between ex spouses/ex partners as a result of their marital or domestic/civil partnership breakdown. They set up an autonomous category, different from the maintenance benefit or compensation reparations for damages.This paper summarizes the assumptions of origin and effects of economic compensation in Argentine law and reviews the current status of jurisprudence.When setting a fiscal compensation, the subjective judgments must also be taken into consideration in addition to the mathematical, accounting and financial aspects considered by the Judge; the criteria of which is bound within the principle of family piety.
