Summary/Abstract: Privacy always had great importance over time since it is a concern of national and international legislation. The Romanian legislator, by the new criminal code, introduced new provisions to punish a surveillance made by a person without the right and the distribution of such illegally obtained material and also the recording of surveillance devices in the home of persons representing a passive subject of these crimes. Criminal liability for such deeds is drawn by mechanisms related to protection of the right to privacy, as it was defined in art. 8 of the European Convention, art. 26 of our Constitution and art. 71 of the Civil Code.
