Summary/Abstract: The paper aims to present the unfair competition in the Romanian Constitution. In this approach we will refer to the constitutional and legal consecration of the unfair competition in Romania and we will show how the accession of our country to the European Union influenced the competition policy. We also want to highlight the benefits and obligations that have an effect on the mechanisms employed by the Romanian state as a member state of the European Union.
