Changes in Management of Waste Economy in the Light of Act on the Maintenance of Clearness of Wastes and Order in Municipalities

Summary/Abstract: The issue of municipal waste management has generated debates at various levels of government. The amended Act on maintaining cleanliness and order obliged municipalities to take responsibility for municipal waste management. The aim of the amendment was to achieve an appropriate level of recycling and to reduce the amount of municipal waste that would be stored. The Act ordered municipalities to introduce their own rules that would regulate the functioning of the system, including the issues of exercising management and control, fixing the rates for collecting waste from property owners, selecting— by means of a tender—the company responsible for collecting waste, and establishing areas for the separate collection of waste (PSZOK). Three years have passed since the Act was implemented. Municipalities are still coping with several problems arising from the fact that legal norms lack clear interpretation. Taking all of that into account, the following study indicates the problems arising from the implementation of the Act, and attempts to evaluate the ways in which the municipal waste management system has been handled. The analysis will focus on the case of Wasilków municipality. The following work examines the main objectives of the Act, the basic legal norms regulating the municipal waste management system, and the process of implementing and operating the system in Wasilków municipality.
