Summary/Abstract: The definition of environmental damage is the answer to the question whether the environment as a whole is a subject of law and can be included in the category of victims of the damaging deed, which implies the need to reconsider the concept of the holder of the subjective right.The concept of “environmental damage” is a relatively recent phrase, used in doctrine and jurisprudence, by adapting the general traits of prejudice, as an element of civil and contractual liability, to environmental conditions.The doctrine uses the term “ecological damage” from a terminological point of view, given the term “dommage écologique” used in French literature.
