Inviolability of the Material Core of the Constitution as a Solution to the Conflict of Constitutional Values

Summary/Abstract: The aim of this paper is to view the unamendability of the material core of the constitution as a solution of the conflict of constitutional values and analyze its consequences for decision-making of the Constitutional Court in this area. In this respect, the role of fundamental rights as principles belonging to the material core of the constitution is very important. Special attention is paid to the possibility of application of proportionality test to decide, whether there was a breach of Art. 9 para. 2 of the Czech Constitution, and to appreciation of the decision of the Nocstitutional Court Pl. ÚS 27/09 in this respect.
