Summary/Abstract: The Act on Consideration of Complaints by Financial Market Entities and on the Financial Ombudsman is a legal measure intended to harmonize the rules for submitting complaints to entities of the financial market. The validity of adopting this piece of legislation, whose basic aim is to raise the level of protection for individuals using financial services, does not beg many reservations. The new law also provides for establishing a new office – the Financial Ombudsman. The author does not question the rationale behind legislative interference in a sphere that is the subject of this horizontal regulation. He nonetheless believes the adoption of too broad a definition of the key term ‘customer’ and solutions introduced to govern certain issues of the formalized complaint procedure, including the appeal, raise some doubts.
