Administrative proceedings for obtaining the permit to sell alcohol: An analysis of discrepancies and proposals for change

Summary/Abstract: The author considers the procedure of issuing permits to sell alcoholic beverages. Problems occur when the number of applications for granting the permit to sell alcohol exceeds the number of issuable permits. In such a situation the question arises as to whether single proceedings should be conducted with all applicants participating, or should there be as many proceedings as applicants. Opinions expressed in legal literature on the subject and judicial decisions concerning this issue are divergent. The author proposes conducting single proceedings in which all applicants participate, and issuing a single decision settling the competing interests of the parties, or introducing tenders in order to grant permits.
