Legal advisers in criminal cases after the amendment of 2015 – remarks on actions concerning property claims

Summary/Abstract: The author analyses changes concerning broadly-understood criminal law that shape the new position of legal adviser in criminal cases. She focuses primarily on the amendments of 2015, which provide for many previously unknown legal structures. Furthermore, she emphasizes former difficulties in court practice and the need for changes emerging from prior experiences. The article refers predominantly to the area of legal advisers’ practice as injured parties’ legal representatives who pursue property claims. The author presents the simplifications introduced with this regard concerning the legal grounds for redressing damage caused. In conclusion, the author positively assesses the amendments. Nonetheless, she does take into consideration the possibility of further modifications that might lead to more rational normative solutions.
