Summary/Abstract: The objective of the article is to analyze the current situation of the right of the convicted person to telephone conversations, considering that the effective exercise of this right depends on the amounts of money available for the payment of the related costs and to identify solutions for the treatment of the sentenced person in in accordance with the requirements imposed by the international documents. The solutions adopted by the Romanian legislation and jurisprudence, in the field, generally comply with the international rules, also presenting similarities with the solutions adopted by other European states. In order to protect those convicted persons, who are additionally vulnerable because of lack of financial means, it is necessary to amend the legislation in order to ensure effective access to telephone conversations. The implications are to clarify the issues discussed, facilitating a unitary practice.
