Summary/Abstract: D. 45.1.35.2 is generally known as the explicit evidence of the possibility to use the verborum obligatio for credit sale realization. A depth analysis of the text (passage), assisted by the valutation of some Varronian texts about the animal’s sales conclusion, can, instead, demonstrate that the fragment we before named simply attets that the stipulatio was used to represent only one sale’s obligation and no the absorption of the whole conventio that the sale contract presupposes.
