Summary/Abstract: Deeply deficient and suspected of extended unconstitutionality, the institution of precautionary measures in the criminal trial has special practical implications regarding the limitations of the exercise of a fundamental right – the property right. Without representing a substitute in the criminal process, the Civil Procedure Code complements, subject to its compatibility, the criminal procedural provisions in the matter, which makes this imperfect normative edifice osmotically imprinted by legal norms belonging to different sources of law.
