Summary/Abstract: The object matter of the article is to analyze the notion of the commercial transaction, in one hand, and the administrative contract, in the other. Based on the present legislation the author attempts to find an appropriate solution of their normative differentiation in cases by which the contracting parties are trader and administrative body.
