Summary/Abstract: The introduction of the workplace monitoring on May 25, 2018 into the Polish Labor Code should be viewed as a positive change. These provisions (amended as of May 4, 2019), while stipulating the terms and conditions of monitoring, also identify the rules concerning restrictions on the freedom of the individual and the protection of the confidentiality of communication related to the use of special surveillance methods in the workplace. On the basis of these rules, employers may, after complying with the established requirements of an organizational and informational nature, use video monitoring, e-mail monitoring and the so-called other types of monitoring. Nonetheless, the provisions concerning possible forms of monitoring appear to be in need of certain improvements and adjustments. This study is focused in particular on those aspects of monitoring that pose formal and merit-related concerns.
