Summary/Abstract: Documents (written evidence) have a quintessential role in the spectrum of means of proof (due to the probative value). Also, in the specialized legal doctrine, there is no comprehensive and thorough study that has as its epicenter the written evidence, after the emergence of the New Civil Procedure Code, especially one that compares how different countries regulate these types of documents. The authentic deed in austrian law represents a fragment of the study aforementioned.The authentic deed is one of the most used types of deeds in civil law. It is important to create a study that analyses the probative value of these deeds in different countries, in order to better adapt the legal provisions of our country. The austrian authentic deed has a lot of distinct characteristics. For example, there are two dimensions of correctness of documents: authenticity and accuracy. A document is considered authentic if it was issued by the person named on it as an issuer. Accuracy refers to the validity of the facts stated in the document. This is the primary reason we chose the authentic deed in austrian law as a subject matter to research in this study.
