The regime of the immovable properties in case of company reorganization

Summary/Abstract: The procedures for reorganization of companies generate practical and legal implications regarding the transfer of ownership right over the immovable properties, in particular with respect to the formal requirements for documents issued in the reorganization process. In practice, throughout time, various remedies have been accepted for non-observance of such requirements for the reorganization deed in case of transfers of immovable properties. With respect to the applicable sanctions, the current legislation in the field of reorganization of companies has to be correlated with the imperative provisions in the field of rights in rem.
