Summary/Abstract: The main problem of Romania, as a member state of the European Union, is the lack of a Maritime Code. Maritime piracy is not a current problem, but a constant problem, since people started sailing the sea. This crime has grown in size lately, in relation to the fact that the favoring element is represented by the precarious legislation regarding the maritime law, but also the legislation of other states. The first objective of an integrated EU maritime policy is to create optimal conditions for the sustainable use of the seas and oceans ensuring the development of maritime transport. Currently there is an increase in illegal maritime activities such as piracy, armed robbery, smuggling of weapons and human beings. These security challenges take place in both national and international waters. Transport is vital for Europe’s internal and external trade and remains the backbone of the maritime activity. However, this sector will only continue to thrive if the EU continues to act in order to establish a high level of maritime safety and security to help protect human life and the environment promoting at the same time international equality. Referring to the analysis of this crime, we can say that the crime of piracy is found among the international crimes, because it is a fact that affects values considered to be of general interest to all states, incriminated by special conventions.
