Evidence used during the criminal proceedings obtained by the extrajudicial authorities

Summary/Abstract: In the article, the author addresses the following issues: a) The legality of obtaining the e-mail communications by the European Anti-Fraud Office and their use in the criminal proceedings; b) The possibility of using as a means of proof, the bank statements obtained by the Department for Anti-Fraud, in accordance with the provisions of art. 113 para. (2) let. c) of the Government Emergency Ordinance no. 99/2006 and attached to the notification document to the criminal prosecution body; c) The means of evidence characteristic of the minutes drawn up by the competent bodies of the National Agency for Fiscal Administration, after the commencement of the criminal investigation based on the ordinance issued by the prosecutor.
