The existence of insurance measures set up in a criminal case on the assets of a legal person, prior to the opening of the insolvency procedure, with a view to special confiscation

Summary/Abstract: The existence of insurance measures established in the framework of a criminal case regarding the assets of a legal person, prior to the opening of the insolvency procedure, with a view to special confiscation, reparation of the damage caused by the crime or guaranteeing the execution of the judicial expenses: a) does not suspend the liquidation procedure provided by the Law no. 85/2014 regarding the seized property; b) it is not of a nature to frozen the asset on which it was started the procedure of valorization, according to the provisions of the Law no. 85/2014; c) does not prevent the liquidation of the goods performed by the judicial liquidator, in the exercise of the competences, as conferred by the Law no. 85/2014.
