Summary/Abstract: The legislative solution contained in the provisions of art. 589 para. (1) let. b) the first sentence of the second sentence of the Code of Criminal Procedure, which excludes the convicted man who has a child less than one year of age, from the possibility of postponing the execution of the prison sentence or life imprisonment, in violation of the constitutional provisions of art. 16 para. (1) regarding the equality of citizens in front of the law and of the public authorities, without privileges and without discrimination, and of art. 26 para. (1) regarding the respect and protection by the public authorities of the intimate, family and private life.
