Summary/Abstract: The Council of State is a very old institution in the current understanding of its meaning. Its history, its independence, the way it is recruited, its rules of conduct and working practices form the strength of its position and make it possible to adapt to all situations, such as the massive, rapid and growing intrusion of Community law. It cannot be said that this adjustment was easy. The Council of State was not accustomed to submitting to any other judicial institution, nor to allowing the principles of its case-law and the rules of public law deriving from it to give way to norms which came from elsewhere. However, community discipline has prevailed and the Community legal order is now part of our daily reality.
