On acquiring from a non-owner

Summary/Abstract: Every legal system has to deal with a key problem: is it appropriate to grant the acquirer a right of ownership to a thing in good faith, even in situations where the transferor of the thing was not its owner or was not otherwise entitled to transfer it? The solution to this fundamental issue is being followed with great interest - unlike many other legal issues - by the general public. In Czech law, moreover, the issue of acquisition from a non-owner is added to the attractiveness of significant shortcomings and inconsistencies in the current solution: of the Code. The present paper focuses on these and similar issues.
