Several issues concerning law in the cyberspace

Summary/Abstract: In trying to define what we can call "cyberspace" in terms of legal science and the so-called broader scientific basis, extreme positions must be avoided. It is not desirable to downplay the issue of network environments and look at them only as means of communication or even more narrowly as mere media. On the other hand, for the purposes of legal science, it is probably not appropriate to resort to the other extreme and define cyberspace as a completely new environment that exists independently and works on patterns diametrically different from the so-called real environment. At the same time, it is not a question of looking for some golden mean among these extremes, but rather of specifically evaluating the existing legal mechanisms, institutes and standards themselves with regard to the functions they are to perform in a qualitatively specific social environment.
