Summary/Abstract: On 1 February 2004, Act No. 22/2004 Coll., On the local referendum, entered into force. The adoption of the new legislation was a logical reaction to in some respects the already surpassed Act No. 298/1992 Coll. Relatively shortly after the discussions on the Constitutional Act on the referendum on the Czech Republic's accession to the EU and on the course of this referendum, the issue of direct democracy in our country is once again in the center of attention not only in legal science. While individual proposals to enshrine a nationwide general referendum within the Czech legal system have been given at least some attention, the issue of referendums at the territorial (ie regional or regional) level remains almost exclusively, so to speak, still arguing in connection with regional self-government issues of permanence or The relative youth of the legislation is, in my view, a mere excuse after almost four years of its actual functioning. I therefore believe that the time has come to at least briefly address some aspects of the possible entrenchment of the regional referendum in the Czech Republic, not only from the point of view of constitutional or administrative law.
