Summary/Abstract: The article will try to define the problem of the legal concept of the subsidiary nature of the unjust enrichment claim under art. 59, par. 2 ZZD. The exposure will go through historical genesis of the institute. The arising problems with the interpretation and usage of the restriction will also be ascribed. It will be followed with the question determining the possible existence of a general unjust enrichment claim.
