Some questions regarding the criteria of the child's best interest according to Decree No 1 of 12.11.1974 on civil case 3/1974 from the Collegy of the Supreme Court and the need to update them in accordance with the contemporary development of family

Summary/Abstract: The focus of the current is to present a critical analysis of the criteria for determining the best interest of the child. The latter, established in Decree No 1 of 12.11.1974 on civil case 3/1974 from the Collegy of the Supreme Court, have been adopted in a different sociocultural sphere and continue to be applied by the settled case law, not taking into account the social developmental stage and the modern understanding of childcare. This study aims to identify precisely what changes should be made to update the criteria set for examining the best interest of the child as to ensure its achievement.
