Summary/Abstract: Although property lawsuits belong to the classical institutes of civil law and have received relatively considerable attention in literature and case law, their nature is often unclear. At the same time, the definition of property actions is not only a theoretical problem, but is crucial for legal practice. Two basic concepts of property lawsuits can be found in the professional literature; one could be described as procedural, the other as substantive.
