EMPLOYMENT OF THE CIVIL LIABILITY OF THE INSURER IN THE CRIMINAL PROCEEDINGS

Summary/Abstract: Insurance is based on the principle of mutuality according to which each insured contributes to the insurance fund covering damages of insured parties. In exchange for a relatively small amount of money, insured parties are guarateed protection against risks, and the insurer manages this fund. The aim of insurance is financial protection, respectively, restoring the insured in their pre-hazard patrimony. This paper draws attention to the pro and con arguments related to civil liability of the insured party in the criminal trial.
