Impact of the Establishment of Succession Administration on the Enforcement-Clause and Enforcement Proceedings

Summary/Abstract: The subject of the article is the assessment of solutions adopted in connection with the entry into force of the succession administration institution into the Polish law system in the context of its impact on the clause-enforcement and enforcement proceedings. First, the goal of succession administration and the status of succession administrator will be presented. In the next part of the article, the institution of succession administrator will be subject to a comparative analysis in relation to other examples of succession property administrators. Finally, the legal consequences of establishing a succession administrator for enforcement proceedings will be presented. The considerations will also concern the scope of the succession administrator’s legal standing to take part in the clauseenforcement and enforcement proceedings.
