Summary/Abstract: In the EU Member States, over 20 million tons of animal by-products (ABP) and derived products are produced annually, of which about 2 million tons in Poland. Their unlawful development of animal by-products and derived products may have a negative impact on sanitary and veterinary safety in the country, through the possibility of spreading animal diseases (eg BSE) or chemical contaminants (eg dioxins). EU regulations regulate their movement, processing and disposal through the necessity to enter in the register activities related to the creation or processing of ABP. But in some cases animal by-products are treated as waste (without losing their original character), which means that their owners are imposed additional obligations resulting from the provisions of law falling behind it.The aim of the study is to answer the question about the ways, criteria and effects of the ABP qualification as waste, as well as the effects of qualifications in the area of transport and disposal or processing requirements depending on the outcome of the qualification.
