Summary/Abstract: Construction with building permit is one of the principal requirements of the rule of law. Obtaining the building permit is a legal right, so the building permit must be issued after it is ascertained that the planned buildings are compliant with the statutory provisions and spatial planning and construction regulations. Subject of this work is building right, illegal construction and the procedure and requirements for the legalisation of illegally constructed buildings in Tuzla Canton. This work contains description of causes and consequences of the illegal construction. Legalisation of illegally constructed buildings is a project which aims to solve longstanding problem of illegally constructed buildings, and – in doing so – to introduce order in spatial planning. The main aim of the enactment of Requirements and procedure for the legalisation of illegally constructed buildings Act in Tuzla Canton is a need for the regulation of legal status for a large number of illegally constructed buildings in recent period, that was especially present in the protected area of main and regional roads, agricultural land, mining fields and landslides. This work also considers the effects of the implementation of the Requirements and procedure for the legalisation of illegally constructed buildings Act in Tuzla Canton area, presenting propositions de lege ferenda, with the aim of improving existing legislative framework.
