Summary/Abstract: The issue of the treatment of Islamic law has started to be discussed in the scientific circles recently, where the Undersecretariat turned to Islamic sciences and worked in this field. It is seen that there are different opinions between the Muslim scholars and the analysts about the period when Islamic law was started to be treated. Some of the Undersecretaries accept the period in which Islamic law began to be promoted as the second century. The main reason for this endeavor is to base the claims of Islamic law on foreign cultures. These claims of the Undersecretaries have been tried to be refuted by some Muslim researchers in recent years. Accordingly, the treatment of Islamic law dates back to the time of the Prophet. On the other hand, the writing of jurisprudence in the present sense started at the end of the period of devotion, and developed in the period of Umayyads. Many Muslim researchers, especially Mustafa al-A'zami and Fuat Sezgin, have important findings on this subject. A‛zami and Sezgin argue that there are many works written in the early period of Islam and they are in the form of books, letters and pages. According to them, these works were transferred in the works that were copyrighted in the following period.
