Summary/Abstract: At first it might seem that the following treatise on the problem of § 261 para. 1 of Act no. No. 513/1991 Coll., the Commercial Code (hereinafter referred to as ObZ) could only be another chapter in a number of purely academic discussions. However, the amendment 103/2000 Coll. disciple. No. 72/1994 Coll., which regulates some co-ownership relations to buildings and some ownership relations to flats and non-residential premises and supplements some laws (Act on Flat Ownership), a precondition was created for the emergence of a significant number of real existing entities, namely from of the Act, which will be entered in the Commercial Register, will thus become entrepreneurs on the basis of § 2 par. 2, letter and ObZ, (see the following explanation), but will not develop business activities.
