Summary/Abstract: Recruitment, training and use within and across national borders of children in hostilities by armed groups distinct from the armed forces of a state and states army raise the problem of criminal responsibility of those who recruit, train and use children in this way. Child soldiers is a cruel and dangerous criminal phenomenon which international community and states have to control and reduce. Protocols on Geneva Conventions, Convention on the Rights of the Child, Optional Protocol to the Convention on the Rights of the Child on the involvement of children in armed conflict from New York, are main tools to use in this respect and practitioners must be familiar with both international treaties and jurisprudence of international criminal tribunals.
