Online Content-Sharing Service Provider according to Directive (EU) 790/2019

Summary/Abstract: This article deals with the online content sharing service provider (OCSSP) as enacted in the European law by Directive (EU) 2019/790 on copyright and related rights in the Digital Single Market (DSM Directive). It analyses each of the definition elements explicitly enacted in Article 2 of the DSM Directive, as well as these resulting from recitals to the DSM Directive. Possible application of each of these elements is then shown on practical examples. Even though the definition of OCSSP is not clear in all aspects, this article is trying to describe and evaluate all the conundrums at stake and to find a practical interpretation of each definition element with help of CJEU case law and other existing sources.
