The implications of the qualification of the Uber activity as a service in the field of transport

Summary/Abstract: The debate on the issues addressed in this study has resulted from the indignation of taxi drivers in the Member States of the European Union, who have brought unfair competition demands before national courts against the digital platform Uber. The purpose of this work is to analyze the case-law of the Court of Justice of the European Union relevant in classifying the service provided by Uber as a ‘service in the field of transport’ and also the consequences. In this context, an in-depth understanding of the concept of ‘service in the field of transport’ and its scope is also needed.
