Summary/Abstract: The subject of this gloss is the decision of the Provincial Administrative Court [WSA] in Białystok of April 22, 2020, case file no. I SA/Bk 177/20. In this ruling, the court examined the issue of admissibility of reinstating time limits for legal action in connection with the existence of the state of epidemics or the epidemic emergency in Poland caused by COVID-19 in the light of the Article 15zzs of the Act of March 2, 2020 on special solutions related to the prevention, counteracting and combating of COVID-19, other infectious diseases and crisis situations caused by them. (hereinafter referred to as “u.s.r.c.”) The nature of the issue raised in the decision that is the subject of this gloss is, as understood more narrowly, the question of from what date does the Article 15zzs of u.s.r.c. is in force, and thus causing the suspension procedural deadlines and time limits, while in a broader sense, the essence of the regulation is the principles of intertemporal application of the law.
