ASPECTS REGARDING THE EXTRAORDINARY APPROACH TO THE ANNULMENT APPEAL

Summary/Abstract: The extraordinary reviews are not included in the regular, common mechanism of the criminal process.The extraordinary reviews are procedural remedies designed to repair the errors contained in the final decisions. The appeal for annulment is an extraordinary review which can be exerted in the limited cases provided by the law, in the purpose that the final decisions pronounced with the violation of the criminal procedure will be canceled. The appeal for annulment is a remedy of withdrawal, the same court who pronounced the decision by breaking the legal norms has the role to cancel the decision in the purpose to eliminate the procedural errors (error in procedendo).
