Summary/Abstract: The right to privacy may be restricted by law only when it is necessary to do so in a democratic society for reasons such as national security, public security, crime prevention or protection of the rights and freedoms of others. Any restriction of this right must be proportionate. The right to privacy protects against unnecessary and cumbersome state supervision and its intrusion into personal lives. The new surveillance technique is likely to violate a reasonable expectation of privacy when eliminating or avoiding a structural law of privacy and disrupt the existing balance of power between police and suspects, making it much less expensive for the state to collect new information.
