Summary/Abstract: The paper examines the application of the more lenient criminal provision in the case of merger of penalties which were imposed according to the former Criminal Code and for which the merger takes place after the entry into force of the New Criminal Code, as well as the application of the more lenient criminal provision in the case of the security measure of expulsion imposed according to section 117 of the former Criminal Code.
