Summary/Abstract: The aim of the article is to describe factors that have had an ifluence on the proccess of creating the Berne Convention. The author takes account of political as well as economic issues which were examined by the scientifc circles during debates before implementing the Berne Convention in 1887. What is more, the author wants to prove that technological progress must be also taken under the consideration while potraying the final form of the treaty. The article shows ways in which the Berne Convention protects copyrights especially by the rule of asimilation and automatic protection. By underlining the role of the Berne Convention in advancement of the copyright law the author points out nowadays issues with application of the treaty.
