Summary/Abstract: Nullity has been throughout time an object of interest both for doctrine and jurisprudence. With its considerable dowry of opinions, taken or not from our legislation, the current regulation is not outside of any criticism. Thus, invoking absolute nullity only by an interested person, by which meaning a person which holds a direct interest, when the protected interest is a general one, practically transforms said interest in a private one. The lack of general rules regarding the sanction of considering the clause as unwritten can lead to confusion, some voices stating that there is no difference between nullity and considering the clause as unwritten. Our goal is to present our own opinion as to these matters and to try to offer relevant solutions for these.
